ember is not medical care
ember is a task-initiation and productivity companion. it is not a medical device, it is not a diagnostic tool, and it is not a treatment for ADHD or any other condition. it does not provide medical, psychological, or therapeutic advice.
nothing in ember is a substitute for care from a qualified professional. if you are struggling, please speak with a doctor or a licensed clinician. if you are in crisis, or you think you may harm yourself, contact your local emergency services or a crisis line right away.
1. acceptance of these terms
these terms are an agreement between you and Szymon Blumczyński IT Solutions, NIP 9721341865 ("we", "us") for your use of the ember app and website ("ember"). by downloading, opening, or using ember, you agree to these terms. if you do not agree, please do not use ember.
2. eligibility
you must be at least 16 years old to use ember, and old enough to form a binding contract where you live. by using ember, you confirm that you meet these requirements.
3. your licence to use ember
we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use ember on devices you own or control, for your own personal, non-commercial use, in line with these terms and any app store rules that apply.
4. acceptable use
please use ember reasonably. you agree not to:
- misuse, disrupt, or attempt to gain unauthorised access to ember or its systems.
- copy, modify, or reverse engineer ember, except where the law expressly allows it.
- resell ember, or use it for a commercial purpose, without our written permission.
- use ember to break the law or to infringe anyone else's rights.
we may suspend or limit access if ember is used in a way that breaks these terms, or that puts the service or other people at risk.
5. subscriptions and billing
ember offers optional paid subscriptions. any free trial, and the price, billing period, and features of a plan, are shown in the app before you buy.
subscriptions are sold through the Apple App Store or Google Play, and are billed to that account. they renew automatically at the end of each period unless you cancel at least 24 hours before it ends. the app store manages your payment, and prices may vary by region and over time.
6. cancellation and refunds
you can cancel at any time from your app store account settings. cancelling stops the next renewal, and you keep access until the current period ends.
refunds are handled by Apple or Google under their own policies, because they process the payment. we are glad to help where we can, but we cannot issue app store refunds directly.
7. intellectual property
ember, including its name, logo, mascot, design, and software, belongs to us or our licensors, and is protected by law. these terms do not transfer any of those rights to you.
the notes and tasks you create remain yours. you grant us only the limited permission we need to store and process them so ember can work for you, as described in the privacy policy.
8. disclaimer of warranties
ember is provided "as is" and "as available". to the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose, and including that ember will be uninterrupted, error-free, or that it will help you complete any particular task. ember supports task initiation; it does not guarantee any outcome.
9. limitation of liability
to the fullest extent the law allows, we are not liable for indirect, incidental, or consequential losses, or for lost data, profits, or opportunities, arising from your use of ember. where liability cannot be excluded, it is limited to the amount you paid us for ember in the twelve months before the claim. nothing here limits liability that cannot be limited by law, such as for death or personal injury caused by negligence.
10. termination
you can stop using ember, and delete your account, at any time. we may suspend or end your access if you break these terms, or if we stop offering ember. some parts of these terms, such as intellectual property, disclaimers, and limitation of liability, continue to apply after your access ends.
11. governing law
these terms are governed by the laws of Poland, and the courts of Poland will have jurisdiction over any dispute, unless your local consumer law gives you the right to bring a claim elsewhere.
12. changes to these terms
we may update these terms as ember changes, or as the law requires. when we make a material change we will update the date at the top, and, where appropriate, notify you in the app. by continuing to use ember after an update takes effect, you accept the revised terms.
